Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and AffiStack (“we”, “us”, “our”) governing your access to and use of https://affistack.store and related features (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

AffiStack is an independent product-comparison and deals website. We are not a retailer, marketplace, or the seller of the products we list. These Terms are provided for transparency and are not legal advice.

1. Who we are

2. The Service

We publish product listings, prices we last verified, editorial comparisons, and outbound links to third-party retailers such as Amazon. You may browse the catalog without an account. Optional features include registration, a wishlist, price alerts, a newsletter, and a contact form.

We do not sell products. We do not process payments, collect tax, ship orders, or provide manufacturer warranties. If you click through and buy, your purchase contract is solely with that retailer.

Information on the Service is for general informational purposes. It is not professional advice and is not an offer to sell any product.

3. Eligibility

You must be at least 18 years old (or the age of majority in your state) and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind it to these Terms.

The Service is not directed to children under 13. See our Privacy Policy.

4. Accounts and security

You agree to provide accurate registration information and to keep your password confidential. You are responsible for all activity under your account. Tell us immediately if you suspect unauthorized use.

We may refuse registration, suspend access, or close an account if we reasonably believe you have violated these Terms, the account is used for abuse or fraud, or we need to protect the Service or other users.

5. Wishlists, price alerts, and communications

Wishlists and price alerts are provided as a convenience. An alert does not guarantee stock, a locked-in price, or notice before a retailer changes or removes an offer.

If you subscribe to the newsletter, we may send marketing emails until you unsubscribe. We may also send messages needed to operate an account or an alert you requested.

6. Affiliate relationships

The Service is free. AffiStack participates in the Amazon Services LLC Associates Program and similar affiliate programs. We may earn a commission from qualifying purchases you make after clicking our links, at no extra cost to you.

7. Third-party sites and Amazon

When you leave AffiStack, the retailer’s terms and privacy policy apply. Amazon, Amazon.com, and related marks are trademarks of Amazon.com, Inc. or its affiliates. AffiStack is not Amazon and is not an official Amazon store.

We are not a party to your transaction with any retailer and are not responsible for their websites, checkout, payment processing, shipping, returns, product quality, or customer service. Direct those issues to the retailer.

8. Prices, deals, and accuracy

We recrawl retailer pages on a schedule and display a last-checked time where available. Price, list price, discount, ratings, images, and availability can change after our last verification, sometimes within minutes.

A deal or markdown badge appears only when we recorded a list or comparable price higher than the live price. We do not invent strikethrough prices. A badge is not a guarantee the offer is the lowest price available or that it will remain.

You must confirm price, tax, shipping, and inventory on the retailer’s site before purchasing.

9. Intellectual property

The Service — including our original writing, site design, software, and AffiStack name and logos — is owned by AffiStack or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to access the Service for personal, non-commercial use.

You may not reproduce the catalog in bulk, scrape listings to build a competing database, frame the Service, or use our marks in a way that implies endorsement.

Product names, images, logos, and customer reviews originating from retailers or brands remain their property. We display them to help you evaluate products.

10. Acceptable use

You agree not to:

• violate any law or third-party right
• attempt unauthorized access, probe, or disrupt the Service
• circumvent rate limits, robots rules, or security features
• scrape, harvest, or bulk-download content except ordinary browsing and what robots.txt allows
• generate fraudulent affiliate clicks or conversions, or overload our servers with automated requests
• impersonate AffiStack or any person, or send spam, malware, or deceptive content through the contact form
• reverse engineer the Service except as permitted by law

We may investigate and block access that we reasonably consider harmful.

Our Privacy Policy and Cookie Policy explain how we collect and use information. By using the Service, you acknowledge those notices.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFFISTACK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that prices or product details are accurate, complete, or current, or that the Service will be uninterrupted or free of errors. Some jurisdictions do not allow certain disclaimers; in those places, our disclaimers apply to the fullest extent permitted.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFFISTACK AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR FROM ANY RETAILER TRANSACTION.

WE ARE NOT LIABLE FOR RETAILER ACTS OR OMISSIONS, INCLUDING PRICING ERRORS, FAILED ORDERS, LATE SHIPMENT, OR DEFECTIVE PRODUCTS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (TYPICALLY ZERO) AND (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some states do not allow limits on certain damages. In those states, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You will defend and indemnify AffiStack and its operators against claims, damages, and reasonable legal fees arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right, except to the extent caused by our own willful misconduct.

15. Termination

You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms or if we discontinue the Service. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.

16. Changes

We may revise these Terms. The “Last updated” date at the top will change. For material changes we may provide additional notice on the site. Continued use after an update constitutes acceptance of the revised Terms.

17. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, except that mandatory consumer-protection laws of your state of residence still apply. You and AffiStack agree to the exclusive jurisdiction of state and federal courts located in the United States, except that you may bring a qualifying consumer claim in your county of residence if the law requires.

We do not require binding arbitration in these Terms. Either party may pursue available legal remedies in court as permitted by law.

18. General

If any provision is found unenforceable, it will be modified to the minimum extent needed, and the remainder will stay in effect. These Terms are the entire agreement between you and AffiStack regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or transfer of the Service. Our failure to enforce a provision is not a waiver.
